Hold Tech Files Ltd has published a new white paper, ‘What non-EU manufacturers of industrial products must do to comply with EU Regulation 2019/1020’. The new Regulation comes into effect on 16 July 2021 and has important implications for manufacturers and suppliers of a wide variety of industrial products. European Regulation 2019/1020 aims to strengthen the requirements for market surveillance by EU Member States. However, it introduces new requirements relating to ‘economic operators’ and this will have an impact on manufacturers and suppliers. Under the new Regulation, manufacturers and suppliers are obliged to have an economic operator established in the EU if they are placing goods on the market.
Annex I of Regulation 2019/1020 lists approximately 70 product Directives, including the Machinery Directive (MD), EMC Directive, Low Voltage Directive (LVD), Simple Pressure Vessels Directive (SPVD), Pressure Equipment Directive (PED) and ATEX Directive. Hold Tech Files has written the white paper to meet the needs of businesses in the industrial sector but its contents are equally applicable to the supply of goods covered by other Directives, such as personal protective equipment (PPE), toys and recreational craft.
The white paper starts with background information about European Regulation 2019/1020, then defines the four different types of organisation that can be classed as an ‘economic operator’. Manufacturers of industrial products will, in most cases, need to appoint an ‘authorised representative’ (AR) to fulfil their obligations.
Of particular interest to manufacturers of industrial products, the white paper explains how to appoint an AR. It also reminds machine builders of the existing requirement in the Machinery Directive to name a person established in the EU on the Declaration of Conformity (DoC) or Declaration of Incorporation (DoI) as being authorised to compile the technical file. This is important for UK machine builders who have been unable to name themselves since UK left the EU.
